Nadmitov, Ivanov and Partners represented the interests of a large energy company - the defendant - in a lawsuit in the 18th Arbitration Court of Appeal, located in Chelyabinsk, in the case of collecting unjust enrichment in the form of a saved payment for the use of a part of the land plot, losses in the form of the cost of the cost of biological reclamation of a part of the land plot, losses in the form of the cost of the uncollected crop as a result of the occupation of a part of the land plot, interest for the use of other people's funds in the total amount of 1.9 million rubles. The appellate court changed the decision of the Arbitration Court of the Orenburg Region, adopted in favor of the plaintiff, reducing the amount of interest for the use of other people's funds by more than 100 thousand rubles. The Court of Appeal agreed with the defendant's arguments that the accrual of interest on the total amount of losses was not lawful.
