Nadmitov, Ivanov and Partners successfully represented the interests of a state educational institution - the defendant in a labor dispute on the reinstatement of an employee at work in the district court of the city of Vladimir. The employee filed a lawsuit against the institution with demands for reinstatement at work, recognition of the orders for disciplinary sanctions illegal, recovery of average earnings for the time of forced absence, recovery of compensation for moral damage and compensation for transportation costs.
In the trial, evidence was presented justifying the legality of the dismissal of an employee for repeated violation of labor duties without good reason (the presence of facts of violation of labor duties, the absence of good reasons for violation, compliance with the order of dismissal and proportionality of the application of disciplinary measures).
Based on the results of the consideration of the dispute, the court of general jurisdiction ruled to refuse to satisfy the claims.
