Nadmitov, Ivanov and Partners Law Firm successfully represented the interests of a large energy company - the plaintiff in a lawsuit in the Arbitrazh Court of the Ryazan Region, in the case of collecting more than 40 million rubles of debt from the management organization of apartment buildings for the supplied heat and heat carrier. The managing organization as objections referred to the incorrect readings of general house metering devices, as well as to the inconsistency of metering devices with the requirements of clause 100 of the Decree of the Government of the Russian Federation of 18 November 2013 No. 1034, which provides for the additional determination of the mass (volume) of the coolant consumed for water intake in systems hot water supply.
In order to protect the interests of the plaintiff, judicial practice was analyzed, the correctness of determining the volume of the coolant was checked, and a legal position was formed.
The court satisfied the stated requirements in full, accepting the arguments of the plaintiff about the compliance of the metering devices with the current legislation, and also recognizing the calculation of the debt prepared by the plaintiff as correct.
