Delgira Khodzhaeva, a lawyer at the Nadmitov, Ivanov and Partners Law Firm, gave comments to Pravo.ru for the article "The SC was deciding whether the bank would answer for the broken order of write-off."
The article discusses the Judgment of the Supreme Court, in which the court overturned the decisions of the lower instances that refused to compensate the employee for losses from the bank that violated the sequence of writing off the funds.
Lawyer Delgira Khodzhaeva believes that the Supreme Court act does not expand the practice, but rather introduces certainty into it. “In this category of cases - recovery of losses from banks due to a violation of the sequence of writing off funds - contradictory judicial practice developed,” the lawyer explains. According to her, the main issue for the courts here is the causal relationship between the violation and the losses.
