A successful case for recovering the cost of water spent on firefighting.
The law firm Nadmitov, Ivanov and Partners successfully represented the interests of a large energy company - the plaintiff in a lawsuit in the Arbitration Court of the Yamalo-Nenets Autonomous District in the case of recovering from the municipal administration the costs of water consumed in the firefighting process. The Administration declared objections to the satisfaction of the requirements, that the reimbursement of such costs should be made by including the consumed water in the form of technological losses in the tariff, there is no obligation for the Administration to compensate for such costs, the plaintiff incorrectly determined the volume of the consumed water. The Arbitration Court collected from the Administration more than 6.4 million rubles, accepting the plaintiff's arguments that the reimbursement of water costs for firefighting needs is a primary fire safety measure and is an expenditure obligation of the local government within the boundaries of the municipality, and also confirmed the calculation the volume of water spent on fire extinguishing.
