Nadmitov, Ivanov & Partners law firm successfully represented an energy company as a defendant in a lawsuit brought by an oil refinery before the Thirteenth Arbitration Court of Appeal to recover 13 million roubles in damages related to the disconnection of the claimant's process equipment in connection with an accident that occurred.
The Court of Appeal accepted our arguments that the main reason for the stoppage of the technological process (part of the equipment) and, as a consequence, the formation of losses, was solely the faulty operation of the refinery's power grid equipment and its wrongful acts/inaction. Following review of the refinery's appeal, the decision of the court of first instance was upheld.
