From 1 January 2021, a heating network organization is an organization that provides services for the transfer of heat energy and meets the criteria approved by the Government of the Russian Federation for classifying the owners or other legal owners of heating networks as heating network organizations
The provision of services for the transfer of heat energy by organizations that do not meet the criteria for classifying the owners or other legal owners of heating networks as heat network organizations shall be carried out in the procedure in effect until the date of entry into force of this Federal Law (01.04.2020), until the end of the current regulatory period established for these organizations, but no later than 31 December 2021 (Federal Law dated 01.04.2020, No. 84-FZ).
The government of the Russian Federation should establish criteria for classifying it as a heating network organization.
Draft Decree of the Government of the Russian Federation (revised text) "On the establishment of criteria and procedure for referring owners or other legal owners of heating networks to heating network organizations, owners or other legal owners of water supply and (or) sewerage networks and (or) structures on them to transit organizations and amendments to some acts of the Government of the Russian Federation "
"45 (1). The assignment of the owners or other legal owners of water supply and (or) sewerage networks and (or) structures on them to transit organizations is carried out if they meet, in aggregate, the following criteria:
a) ownership on the right of ownership and (or) on another legal basis for a period of more than twelve months, water supply and (or) sewerage networks used to provide services for the transportation of cold water and (or) waste water for the purpose of cold water supply and (or) sewerage subscribers of the guaranteeing organization (another organization that carries out cold water supply and (or) sewerage), while the total length of the sections of these networks within one centralized water supply and (or) sewerage system is:
for settlements, urban districts within which this centralized water supply and (or) sewerage system is located, with a total population of 500 thousand people or more, as well as federal cities of at least 3 kilometers (determined separately for water supply and sewerage networks);
for settlements, urban districts within which this centralized water supply and (or) sewerage system is located, with a total population from 250 thousand people to 500 thousand people at least 1 kilometer (determined separately for water supply and sewerage networks);
for settlements, urban districts within which this centralized water supply and (or) sewerage system is located, with a total population of less than 250 thousand people at least 250 meters (determined separately for water supply and sewerage networks);
b) the share of the maximum capacity (load) of water supply and (or) sewerage networks and (or) structures on them, intended for water supply and (or) water disposal for their own needs of legal entities or individual entrepreneurs who are the owners or other legal owners of water supply and ( or) sewer networks and (or) structures on them, does not exceed 20 percent of the total maximum value of the capacity (load) of water supply and (or) sewer networks and (or) structures on them, belonging to the right of ownership and (or) on other legal on the basis of the specified legal entities or individual entrepreneurs;
c) the existence of organized activities of the emergency dispatch service, including by concluding an agreement for the provision of services with an organization carrying out emergency dispatch services, for a period not less than the settlement period of regulation;
d) the presence of an official website in the information and telecommunication network "Internet".
