Changes in the regulation of biometrics

The State Duma of the Russian Federation has approved in the first reading the bill of Federal Law No. 353266-8 "On Amendments to the Code of the Russian Federation on Administrative Offenses".

The bill proposes to establish administrative liability for placing the biometric personal data the Unified Biometric System (EBS), in other information systems that provide identification and/or authentication using biometric personal data of individuals, in violation of the requirements established by law.

In addition, the bill proposes to increase the existing liability for illegal processing of personal data to similar values. The fine for individuals for such violations will be from 6,000 to 10,000 rubles, for officials - from 100,000 to 300,000 rubles, and for legal entities - from 300,000 to 700,000 rubles. In case of repeated violation, the amount of the fine for officials will be 500,000 rubles, for individual entrepreneurs - 1 million rubles, and for legal entities - 1.5 million rubles.

This bill is supported by the Government of the Russian Federation, the Ministry of Justice of Russia, the Ministry of Digital Development, Communications and Mass Media of Russia, the Ministry of Internal Affairs of Russia, the Ministry of Finance of Russia, the Federal Security Service of Russia, the Federal Service for Supervision of Communications, Information Technology and Mass Media (Roskomnadzor), and the Central Bank of Russia.
