Mikhail Stepkin, senior lawyer of the Nadmitov, Ivanov and Partners Law Firm, gave comments to Pravo.ru for the article "Returning a legal right due to violation of jurisdiction: a life hack from the Supreme Court".
The district court considered the case on the deprivation of a driver's license, but should have a magistrate, since the administrative investigation was not actually carried out. However, the Supreme Court noted that the conduct of an administrative investigation does not in itself affect the change in the rules of jurisdiction. It is necessary that in a particular case there are grounds listed in the Code of Administrative Offenses for its conduct.
According to senior lawyer at Law Firm Nadmitov, Ivanov and partners Mikhail Stepkin, the Supreme Court's act will reduce the number of judicial errors associated with determining the jurisdiction in this category of cases.
