The law firm "Nadmitov, Ivanov and Partners" successfully represented the interests of the plaintiff in a dispute on the recovery of overpaid funds under agreements on the management and operation of an aircraft in the International Commercial Arbitration Court at the Chamber of Commerce and Industry of the Russian Federation ("ICAC at the Chamber of Commerce and Industry of the Russian Federation") in the Russian right.
The plaintiff handed over a private jet to a European management company for management and operation. After several years of operating the aircraft, the client had doubts about the amount of the paid amounts and he hired our firm for legal and financial due diligence (audit). As a result of a painstaking check of more than seven thousand records, a significant overpayment of expenses of the management company was revealed.
The plaintiff applied to the ICAC at the RF CCI with a statement of claim for the recovery of the overpaid funds. We presented detailed calculations, counter documents from contractors, expert opinions. The arbitral tribunal ruled to recover the amount of unjust enrichment in favor of our client, and also awarded reimbursement of the costs and expenses of the arbitration.
