In the first issue of 2018, an article by Alexander Nadmitov and Maxim Bashkatov appeared in the Russian Law Journal "Performance of Derivative Transactions through the Central Counterparty". The article is devoted to contractual models, which are designed to formalize the legal relationship between clearing participants (parties to the original derivative transaction) and the Central Counterparty (CCP). The authors consider the legal concepts of innovations, the so-called "open offers" and assignments, which are widely used in international practice. Taking into account some peculiarities of Russian legislation and the experience of comparative jurisprudence, the authors come to the conclusion that the concept of cession is best suited for the Russian legal framework.
