Proposed Amendments to the Bankruptcy Law

The Government of the Russian Federation has submitted two bills for consideration aimed at clarifying and expanding the rules governing bankruptcy procedures. The amendments concern the deadlines for entering bankruptcy information into the register and providing the possibility of extrajudicial bankruptcy for participants in a special military operation (SMO).
The first bill (No. 853428-8) clarifies the procedure for calculating the ten-day period for entering bankruptcy information into the register. According to the proposed changes, this period will begin on the date the arbitration court issues an act on the completion of the bankruptcy procedure. This amendment was a response to the ruling of the Constitutional Court (No. 44-P of October 7, 2024), which pointed out the ambiguity of the current wording of the law. The new version of the norm is intended to eliminate legal uncertainty and ensure uniformity in the application of legislation.

The second bill (No. 853432-8) is aimed at supporting participants in the special military operation, giving them the opportunity to use the extrajudicial bankruptcy procedure. According to the initiative, military personnel will be able to declare themselves bankrupt if their debt does not exceed one million rubles. This step is aimed at additional social protection of SMO participants and their adaptation to economic conditions after returning to civilian life.
